BOOKING TERMS AND CONDITIONS

Fuga Latin Travel PTY LTD (ABN: 43698876130)

Official Contact: info@fugalatintravel.com

Welcome to Fuga Latin Travel. The following are the legal terms and conditions that apply to the use of our website and your travel bookings. By making any payment through our links, payment gateways, or corporate bank transfers, you confirm that you have read this document, that all passengers named on the booking are of legal age (where age restrictions apply), that the information provided is accurate, and that you accept these terms in their entirety:

1. Our Role: We Are Your Independent Booking Agent & Coordinator

Fuga Latin Travel acts strictly as an independent intermediary travel booking and coordination agency. For itineraries within South & Central America, we design custom travel packages and facilitate bookings by coordinating directly with local ground operators, local third-party travel agencies, transport companies, and accommodation providers in the destination country.

We do not own or physically operate any tours, vehicles, or accommodations ourselves. All arrangements are subject to the individual terms, conditions, and operational regulations of each local supplier. When purchasing services through us, we charge an upfront Professional Service Fee for our curation, translation, and coordination work, and/or receive an agent margin from local suppliers.

2. Your Responsibilities as a Traveler

  • Documentation Review: It is your sole responsibility to check that the dates, names, and details on your travel vouchers are correct as soon as you receive them from us. Furthermore, you must hold a valid passport (with a minimum of 6 months validity from the return date) and secure any necessary visas, reciprocity fees, or entry/vaccination requirements for the destination countries in South & Central America.

  • Accurate Information: You must provide accurate and relevant data regarding your age, fitness levels, medical restrictions, or dietary requirements. In international adventure or remote travel, failure to provide accurate data may result in the local supplier denying you service at the destination, in which case a 100% cancellation fee will apply.

  • Conduct at Destination: If your behavior during the trip causes distress, danger to third parties, or property damage, the local operator reserves the right to terminate your service immediately without any right to a refund.

3. Manual Booking Confirmations & Price Fluctuations

  • Awaiting Local Confirmation: Because bookings for South & Central America are managed through direct coordination with local operators across different time zones, your booking is not finalized at the immediate time of your payment. Fuga Latin Travel will secure and confirm services with local suppliers within 48–72 hours of receiving your funds. If a specific service or hotel becomes unavailable during this window, we will offer an alternative of equal standard or issue a full refund for that specific component.

  • Currency & Dynamic Pricing: All quotes are calculated and processed in Australian Dollars (AUD). However, local supplier rates are tied to foreign currencies and volatile local markets. Prices are subject to change without notice until your booking is paid to us in full. Once full payment is received, your price is locked, with the exception of local government tax increases or mandatory local park fees.

4. Payment Methods, Gateway Fees, and Local Costs

  • Payment Channels: Payments can be processed via our secure external payment links (Stripe or PayPal) or via Direct Bank Transfer (EFT/Osko) into our Australian corporate bank account.

  • Bank Transfer Clearance: For clients electing to pay via Direct Bank Transfer, funds must be fully cleared and visible in our corporate account before Fuga Latin Travel PTY LTD initiates any manual booking or sourcing coordination with local suppliers. Fuga Latin Travel is not liable for price increases or loss of availability resulting from delays in bank clearance times.

  • Non-Refundable Charges: Initial deposits required to lock local services, international bank wire fees, and any credit card/payment gateway transaction fees are strictly non-refundable and non-transferable under any scenario.

  • Mandatory Local Fees: Certain travel components in South & Central America require cash payments directly at the destination due to local regulations. Examples include local airport taxes, national park entrance fees, eco-tourism taxes, or optional local tipping. These are your responsibility and are not included in your upfront package price.

5. Adventure Activities & Medical Conditions

Adventure, high-altitude treks, scuba diving, and multi-day tours are operated entirely by independent local companies and are strictly governed by the safety regulations and local laws of the country where the activity takes place. By booking any adventure or high-risk activity, you confirm under medical declaration that you are in optimal physical health, do not suffer from severe respiratory, cardiac, or neurological conditions, and hold appropriate international coverage for high-risk sports. If a local provider denies you participation due to local safety codes, standard operating guidelines, or undisclosed medical conditions, a 100% cancellation penalty applies.

6. Cancellation, Refund, and Professional Fee Policies

All cancellation requests must be submitted formally in writing via our official email or WhatsApp, and receipt must be explicitly confirmed by our team. Financial terms will be strictly applied as follows:

  • Upfront Professional Service Fee is Non-Refundable: The initial Professional Service Fee charged by Fuga Latin Travel PTY LTD for custom itinerary design, local supplier sourcing, and translation/coordination represents professional labor already fully delivered. This fee is strictly non-refundable under any circumstances (including customer cancellation, local supplier cancellation, or force majeure events).

  • Supplier Refund Dependency (Direct Operations): Because funds must be wired internationally to local providers in South & Central America, any refund request is strictly subject to the cancellation policies of those local operators and their country's legal frameworks. Fuga Latin Travel PTY LTD acts as your coordinator and can only pass on refunds that are successfully recovered and returned clean to our Australian bank accounts by the local suppliers. No travel credits option will be offered by our agency; whatever is refundable by the supplier will be returned to your card minus processing fees.

  • Last-Minute Time-Zone Cancellations (<48 hours): If an urgent cancellation occurs less than 48 hours prior to service departure and outside Australian operating hours, the client is recommended to try to speak directly to the local supplier/operator to avoid their immediate 100% cancellation fee. Fuga Latin Travel PTY LTD will take over the formal administration and dispute process during our standard Australian operating hours.

  • If YOU Cancel the Trip (Customer-Initiated Cancellation): If you cancel your trip for any personal reason, you will be liable for the cancellation penalties of the local suppliers (which can be up to 100%). Additionally, Fuga Latin Travel PTY LTD will charge an Administrative Cancellation Fee of $50.00 AUD per hour to cover the extensive manual labor, international wire reversals, and local negotiations required to dismantle your itinerary. This hourly fee and any Stripe/PayPal reversal charges will be deducted from the balance recovered from suppliers before any remaining funds are returned to your card. Travelers are strictly advised to claim these losses through their travel insurance.

  • If the Local SUPPLIER Cancels or due to Extreme Natural Disasters (Force Majeure): If a local operator cancels due to weather, local strikes, political unrest, or catastrophic events (earthquakes, hurricanes, cyclones, or pandemics), Fuga Latin Travel PTY LTD will charge an Administrative Force Majeure Fee of $50.00 AUD per hour to cover our time and labor spent dealing with, mitigating, and reversing the logistical issue with suppliers. We will transfer back any net funds successfully recovered from the local operator, minus this hourly fee, international bank transfer fees, and payment gateway charges.

7. Limitation of Liability & Local Infrastructure

Fuga Latin Travel PTY LTD accepts no legal or financial liability for personal injury, accidents, illness, death, property damage, luggage loss, theft, delays, itinerary alterations, or additional expenses incurred during your travels. Travel infrastructure, road conditions, and safety standards in South & Central America are governed solely by local laws and vary from Australian standards. All mishaps are the exclusive liability of the final local provider. Purchasing comprehensive international Travel Insurance with medical evacuation and cancellation cover is a mandatory condition of booking.

8. Governing Law and Jurisdiction

These Terms & Conditions are governed by, construed, and enforced in accordance with the laws in force in the state of New South Wales (NSW), Australia. Any legal disputes arising directly out of our intermediary and consulting services shall be subject to the exclusive jurisdiction of the courts of NSW.
